PARTIES:
“We” “Us” or “Council” refers to St Albans City and District Council that own the facility and where the context permits, will include the Agent when acting on the Council’s behalf.
“You” refers to the legal person entering into these terms and conditions to receive the leisure services at the facility.
“Agent” or “Everyone Active” means Sports and Leisure Management Limited (Company Number 02204085) and Everyone Active Charitable Trust (Registered Society Number: 9359), each of which are registered at 2 Watling Drive, Sketchley Meadows, Hinckley, LE10 3EY.
Our Agent
We have appointed Everyone Active to act as our Agent when selling and providing the leisure services at this facility. Your membership contract is with the Council but the Agent may enforce these Terms and Conditions on our behalf.
Agreed terms:
Direct Debits
- You can choose how you pay for your membership with us. A monthly direct debit can be set up with your bank. The payment will come out of your bank on the 1st working day of each month. Alternatively, you can pay for 12 months in advance. All members whether paying annually or by monthly direct debit, will pay a start-up fee that will cover the administration of your membership and your introduction to your activity.
- If you have chosen to pay by direct debit:
- the Agent will collect your direct debit on 1stof each calendar month or the nearest working day after this. If a direct debit is returned by your bank unpaid, we have the right under BACS regulations to re-present a request for this payment at any point without notice but within one month of the original charge; and
- you will also pay a pro rata payment and a final month in advance payment. The pro rata payment will be taken from your bank with the first direct debit payment:
- If you have a Fitness Membership (including Swimming Only Membership), this pro rata payment covers the cost of your membership until your direct debit has been set up with your bank. The final month in advance payment is to cover your usage when we come to close your account with us; or
- If you have a Swimming Lesson & Sports Course Membership, the collection from your bank will always be for the lessons to be taken in the next calendar month. This protects your place on your chosen lessons. All members who have swimming lessons or courses with us can enjoy free public swimming sessions at all Everyone Active centres with pools, all year-round except for Coral Reef Waterworld, Derby Moorways Water Park and all outdoor pools/lido’s. (Note: Those under 8 years old must be accompanied by a paying adult.).
Annual Membership
- If you have purchased an Annual Membership, you have agreed to a minimum membership term of 12 months. As we offer a heavily discounted Annual Membership for customers, it cannot be cancelled or transferred once it has been purchased.
Restrictions on your membership
- Discounted, promotional or concession rates on membership are excluded from any further discount obtained through a third party offering or other types of discounted offer.
- Where you request to move to a new membership, any discounts or promotion will be not be transferrable. This includes any Price for Life promotion which is linked to the purchased membership subscription only.
- Your membership may only be used by you, the named person who holds the membership record. Should any other person be found to be using your membership, your membership will be at risk of being blocked and further access to the facilities may be denied. Usage will be monitored and if abused, your membership may be cancelled with no refund provided for any unused part of the membership.

Termination
- We reserve the right to terminate your membership at any time without notice.
Membership Freeze – ‘Pause your membership’
- As a benefit to Direct Debit memberships only, we offer the opportunity to temporarily pause or ‘freeze’ your membership in the event of prolonged absence such as serious illness or injury. This benefit is for full calendar months only and available for a minimum of 1 calendar month up to a maximum of 6 calendar months. It carries a reduced fee of £5 per member per month*. This benefit is for monthly direct debit fitness memberships and golf memberships only as we cannot hold lesson or course spaces open unless supported with a valid medical exemption from a medical professional.
- Freezes can only commence after the first direct debit has been taken (including any pro rata payment). Any promotional offer or discount period attributed to the freeze period will not be extended. To activate this benefit, please request a suspension of your membership from our website, Freeze My Membership Request before 20th* of the month to be effective the 1st of the following month, as you will need to agree to the term of the freeze.
- At the end of the ‘frozen period’ your monthly direct debit will revert to the appropriate fee automatically.
*For months containing UK bank holidays, this date may be subject to change.
Money Back Guarantee
- A 14 day money back guarantee is offered to all new members. All monies paid in respect of the membership or swimming lessons will be refunded in full should you for any reason wish to terminate your membership within 14 days of joining. To claim this, please complete the enquiry form and we will be in touch. Swimming lesson membership is non-refundable after 14 days and is non-transferable. We reserve the right to retain any administration fee.
Change of Details
- Should your personal details change, please notify the Agent immediately. The details we hold for you will be used to communicate electronically or by letter with you as per BACs regulations. You can make changes in the profile area – Change Settings, or you can notify us in centre or by visiting our requesting through the Everyone Active website – Request Changes.
Prices
- Prices may be reviewed at any point during your membership and we undertake to provide at least 3 working days’ notice of any price change either by email where this exists, or by post.
Disruption
- Where we have to alter hours of business or change activity programmes, every attempt will be made to provide advance notice and to minimise disruption and inconvenience. Compensation in the form of use of alternative facilities, activity vouchers, or pro rata refunds may be offered where disruption is significant and set to continue for an extended period. Please note that this will not apply where disruption is caused by adverse weather conditions.
Conduct
- We expect our members to behave in a considerate manner and will not accept any inappropriate behaviour towards other members or ours or Everyone Active’s colleagues. We reserve the right to refuse admission for members behaving in such a manner.
Membership Cards and Photo Identification
- All customers will be provided with a personal membership number which they will be required to present via card/fob or barcode on each visit to the facility. The card or fob remains the property of the Agent. In the event you lose your card/fob, a replacement will be made available at a nominal charge. The card/fob may only be used by the person to who, it has been issued.
- On your first visit to the Centre, you will be required to have your photograph taken so we can identify that only the holder of the membership is accessing the facilities. This is to safeguard all our members in relation to health and safely and ensure only those members paying for a Membership subscription are being allowed access. The Agent will store the photograph in accordance with its Privacy Policy.
- Your photograph will not be used in any other way other than for identification purposes.
Personal Property, Injury, Illness and Death
- You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition which might interfere with you exercising safely, before you use our equipment and facilities you should get advice from a relevant medical professional and follow that advice as detailed in Everyone Active’s Health Commitment Statement.
- Subject to the final paragraph of this section, we nor our Agent will not be liable to you for any loss or damage you may suffer where the same is attributable to:
- Your own fault
- A third party unconnected with our provision of services under this agreement; or
- Events which neither we nor our suppliers could have reasonably foreseen or forestalled even if we had taken all reasonable care.
- Nothing in these terms and conditions is intended to limit or exclude our or the Agent’s liability for death or personal injury caused by our or the Agent’s negligence or for fraud, fraudulent misrepresentation or any other liability which cannot be excluded by law.
Cancelling | Membership or Classes
Cancelling your direct debit membership:
- We recognise that many people’s circumstances change. In such an event, should you wish to cancel your direct debit membership we ask that you notify, in writing, your centre or visit the Everyone Active website, filling in an enquiry form. Please ensure you also notify your bank. This needs to be done before the 20th of the month in order to be effective from the 1st of the following month. Your membership will therefore continue until the end of the following month. Example: Cancel between 1stand 20th July, last payment was 1st July, membership will expire on 31st August, utilising final month in advance period*. We do not provide a refund for part months or the last month up front as this is your notice period.
- Where notification is not received by the 20th of the month, we reserve the right to collect the following month and notice of your cancellation will be deemed to have been given in the following month. Your membership will therefore continue for a further two months. If you wish to re-start your membership with us you will be required to pay the start-up fee, pro rata payment and your last month up front. Example: Cancel between 21st and 31st July, last payment will be 1st August, membership will expire on 30th September, utilising last month up front period.
* Golf memberships will have a two-month cancellation period.
Cancelling Programmed & Bookable Activities
- Your Membership may entitle you to book classes or activities which are included in your membership.
- In order to make booking fair and sustainable for all our members we ask that all members are considerate of others and do not book an unreasonable number of sessions which may have an impact on other members’ ability to use their membership. Should members book multiple daily sessions we reserve the right to cancel any bookings we deem to be excessive including any sessions that are simultaneous where it is clear that the customer could not undertake both at the same time.
- If you are unable to attend bookings, you must cancel as soon as possible. If your booking was not included in your membership and paid for, you will be required to contact the centre to cancel and bookings will be non-refundable. Alternative times may be offered at Everyone Active’s discretion.
- Whilst most of our members, when unable to attend a booked activity cancel in good time to allow others to book, others do not attend preventing other members attending. In order to maximise spaces for our members we will impose a £4 “no show” charge for those that either fail to show up or cancel within 4 hours of the start time. Specific activity membership “no shows” will be subject to the same conditions and a dishonour charge in proportion to the activity will be applied. These can be found in the Activity Memberships section.
- You can pay any “no show” charges online or at reception at your facility. Please note that until you have paid any outstanding “no show” charges, you will be unable to book on to other classes/activities and the turnstiles at the centre will not let you in.
- Waiting Lists will now be available on most classes and swim sessions so that when people cancel a class or session, those on a waiting list will be communicated with. In order to ensure places are not held for too long, places on waiting lists will only be held until 4 hours before the class or session start time, after which time the waiting list will be cleared and any member can book on if there are spaces available (this will be done on a first come first served basis).

- For all other member enquiries and activity bookings please contact our Agent, Everyone Active, using the appropriate option on Contact Us on the Everyone Active website or contacting the leisure centre directly.
Law and Jurisdiction
- These Terms of Use shall be governed by and construed in accordance with the laws of England. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and your use of the site confirms your agreement to this jurisdiction. Any cause of action you may have with respect to these Terms of Use must be commenced within one (1) year after the claim or cause of action arises.
- If any of these Terms of Use is determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these Terms of Use are intended to be effective, then to the extent to which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining Terms of Use shall survive and continue to be binding and enforceable.
MEMBERSHIP OFFERINGS
MOVE+ Membership
Members will have access to the Gym, Group Exercise Classes and Public and Lane Swimming at the centre where purchased plus any Everyone Active centres with the same price point or below. A 7-day advance booking for Gym, Classes and Swimming is standard. Toning Suites, Health Suites and Saunas are included where this is available (but this excludes all Spa’s). Standard fitness membership is for age 16+. Additional centre usage upgrade available on this membership option only. Access to Perks and Everyone On Demand (EOD) is also included. Access to the MOVE+ pillar is included.
YOU+ Membership
Members will have access to the Gym, Group Fitness Classes and Public and Lane Swimming at the centre where purchased. YOU+ adult gym membership is for age 16+.
- Two free guest passes per month**
- Access to Move, Recovery, Sleep, Nutrition, Social Wellness and Brain pillars
- Access to Everyone on Demand (EOD)
- Access to the Health Hero GP app. All terms for this app can be found on their registration pages.
YOU+ Ultimate Membership
Members will have access to the Gym, Group Fitness Classes and Public and Lane Swimming at the centre where purchased plus all our other centres.
- A 14-day advance booking* for all bookable activities included in the membership is standard, plus access to our virtual App, EA OnDemand, Spa (casual, not treatments), Fortis, and Hot Yoga.
- Toning Suite, Health Suites and Saunas are all included where this is available. YOU+ Ultimate gym membership is for age 19+.
- Two free guest passes per month**
- Enhanced access to our new member benefits package, Perks+
- Access to Move, Recovery, Sleep, Nutrition, Social Wellness and Brain pillars

Concession adult gym memberships
Members will have access as per our Standard fitness adult memberships at a reduced rate. Additional centre usage upgrade is not available on this option. Age 16+. Evidence of concession entitlement is required with purchase.
- Concessions are available for:
- Seniors aged 66+*
- Students aged 16-18 inclusive
- Those aged 19 and over where in full time education
- Members in receipt of Universal Benefits (excluding Child and Working Tax Credit), or Full Time Carers Allowance*
- Emergency Services personnel including NHS and Armed Forces
Swimming memberships
Memberships are for use only at the centre where purchased and will include all Public and Lane Swimming plus access to Aqua classes. A 7-day advance booking is standard. Additional centre usage upgrade is not available on this option. Age 16+.
Junior memberships
Members aged 11 to 15 will have access to the Gym and Public and Lane Swimming for use only at the centre where purchased plus our centres with the same price point or below. A 7-day advance booking for Gym and Swimming is standard and only one gym session can be booked per day.
Children aged 11-13 can have supervised fitness team sessions whilst those aged between 11-15 can be supervised by a legal guardian aged 18 or over (Note: the legal guardian must be a current gym member). Includes group exercise classes suitable for ages 14+ (where available). Additional centre usage and 14-day advance booking upgrades are not available on this option. Some standalone equipment may not be used by children aged between 11-15.
GP Referrals
Members will have access to the Gym, Group Exercise Classes and Public Swimming for use only at the centre where purchased but must follow the exercise routines as prescribed by their GP referral instructor. A 7-day advance booking for Gym, Classes and Swimming is standard, plus access to our virtual App, EA OnDemand. Evidence of referral from a medical professional is required with purchase and this product is only available in centre and not online. Additional centre usage upgrade is not available on this option. Membership will be automatically upgraded to standard fitness after a period of 6 direct debit collections. Age 16+.
Everyone On Demand
Our Agent, Everyone Active, offers a virtual fitness App, Everyone on Demand (“EOD”). EOD gives customers access to a variety of third-party apps. These products will change from time to time and there is no guarantee that any particular app will be available from one month to the next. Available only as a monthly Direct Debit. Age 16+. Additional Centre Usage upgrade
As our Agent, Everyone Active, runs leisure centres for multiple local authorities, certain memberships may be eligible for an upgrade to allow you to use additional centres run by our Agent. Please note that this upgrade will only be a part of your membership terms whilst Everyone Active acts as our agent in running these leisure services. All membership types provide access to lane swimming only in outdoor pools/Lido’s
*Our Agent currently operates Coral Reef Waterworld in Bracknell and Moorways Water Park in Derby, these sites are not included in your membership with us.
**Guest Pass Terms & Conditions
- Pass is valid for 1 day’s use.
- Available for over 16’s only
- To validate your pass, simply ask your guest to show at reception. Please bring one proof of ID with you that confirms your age.
- Free pass entitles the user to unlimited use of the gym, pools and classes at their chosen site.
- One pass per person.
- The same individual cannot redeem the pass on multiple occasions.
- All customers must complete an application form for a ‘Membership card’ at the centre. A valid email address must be provided.
- All customers wishing to use the gym must complete an induction (provided free of charge) and complete a Health Commitment Statement.
- All classes must be booked in advance. Classes are subject to availability.
Activity Memberships
- Golf
7-day membership from Monday to Sunday or 5-day membership Monday to Friday. Available as DD or Annual. Single site access only. Direct Debits will charge 2 months in advance and therefore covers a 2-month cancellation period at the point the membership is cancelled. To ensure availability for all and in accordance with our “Programmed & Bookable Activities Policy”, we have imposed a £15 dishonour for members who do not show or failure to cancel within 4 hours of their booking. This charge will be applied to their membership and require paying before any further bookings can be made.
- Ice-Skating
7-day advance booking. Single site access only. Adult and Junior memberships with access to public ice-skating sessions. ‘Patch’ memberships are only available in centre only for those skaters who have achieved the Skate UK Star Level 4 or above. DD or annual.
- Spa
Single site access only. Available as DD and Annual. 7-day advance booking. Age 16+. Up to 20% off all Spa treatments included.
- Fortis
Single site access only. Available as DD and Annual. 7-day advance booking. Age 16+
- Climbing
Single site or multi-site options available. Available as DD and Annual. Adult and Junior memberships with access to casual climbing sessions.7-day advance booking.
- Athletics (Track)
Single site access only. Available as DD and Annual. Adult and Junior memberships with access to public track sessions.7-day advance booking.
- Hot Yoga
