    Terms & Conditions

    These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the terms and conditions and by participating, all entrants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

    PROMOTER: SLM (Everyone Active), 2 WATLING DRIVE, SKETCHLEY MEADOWS, HINCKLEY, LEICESTERSHIRE, LE10 3EY.

    1. The promotion is open to GB residents aged 17 plus only. Employees of Everyone Active and their subsidiaries, other group companies, their immediate families, their agents or anyone else professionally connected with the promotion may not enter.
    2. To enter the prize draw, please complete the entry form found on this page.  A full name, valid email address and phone number details must be provided to qualify for entry. Only one entry per person allowed.
    3. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.
    4. Prize Details:

    The prize consists of:

    • An annual family fitness membership for 2 adults aged 17 plus and 2 children aged 8 – 16 years to be redeemed at an Everyone Active leisure centre within Middlesbrough – Middlesbrough Sports Village, Neptune Centre or Rainbow Leisure Centre. For children aged 8 – 10 prize will consist of a swim membership and for children aged 11 – 16 a gym membership.     • 4 tickets to see a Middlesbrough Football Club 2024/25 season League home game of your choice. This is for 2 adults and 2 juniors (aged 17yrs and under) in the family zone at the Riverside Stadium.
    • The opportunity for the winner and 2 guests to go on stage at the Middlesbrough Lights Switch on on 28.11.24 at 17.30 to collect your prize and help to turn on the Christmas Lights
    1. The opening date for entries is 00.01 hours on 16.11.24. The closing date for entries is 23.59 hours on 24.11.24.  Any entries received outside the promotional period will not be accepted.
    2. Incomplete, illegible, invalid, or misdirected entries will not be accepted. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
    3. All correctly completed entry forms will be entered into the prize draw. The winners will be selected at random by an independent person from all correct entries.
    4. The winners will be drawn on 25 November and notified by both phone and email on that day. The winner will be presented with their prize on stage at the Middlesbrough Light Switch on at 17.35 on 28.11.24.  If the winner is not going to be present at the event, they will be given a letter and asked to come into their chosen centre to redeem their prize and set up their membership. They will also automatically forfeit the chance be on stage when the Middlesbrough Christmas Lights are switched on.
    5. If a winner does not claim a prize within 14 days of first being notified, rejects their prize or is ineligible, then another winner will be drawn using the same methodology as above. The process will be repeated until an eligible winner is able to claim the prize. Entrants are encouraged to monitor their connections during this time in case they are a winner.
    6. If the winner and their guests are already fitness members of Everyone Active and paid in full up front, their prize will be added to their membership term. If the winner and their guests are already a fitness members of Everyone Active and paying by monthly Direct Debit, their prize will start after the period covered by their Direct Debit ends.
    7. No responsibility can be taken for entries where telephone and/or email details have been provided incorrectly and a winner cannot be contacted.
    8. There are no cash alternatives in whole or in part to the stated prize and unless otherwise agreed in writing by the Promoters, the prizes will only be awarded directly to the winners.
    9. The Promoter reserves the right to substitute the prize with something of equal or greater value in the event of unavailability due to circumstances beyond the Promoter’s control.
    10. Winners may be requested to have their names announced on Everyone Active’s website and to be used for publicity purposes if requested. Winners may be requested to take part in publicity in the form of photographs or interviews with Everyone Active. For the avoidance of doubt, no children will be requested to participate in any publicity.
    11. The winner’s surname and county of residence is available by emailing: [email protected] within three months of the Closing Date. The Promoter reserves the right to refuse such requests. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting [email protected].  We may nevertheless disclose the information to the Advertising Standards Authority if required to do so.
    12. The Promoters reserve the right to verify all entries including but not limited to, asking for proof of ID (passport, driving licence or equivalent) which they must provide within 14 and to refuse to award a prize or withdraw a prize entitlement and/or refuse further participation in the promotion and to disqualify the participant where there are reasonable grounds to believe that there has been a breach of these terms and conditions, the spirit of the promotion or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained an unfair advantage in participating or won by fraudulent means.
    13. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse and/or error (human or computer) affects or could affect the proper operation of this promotion and only where circumstances make this unavoidable, the Promoters reserve the right to cancel or amend the promotion or these terms and conditions at any stage, but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
    14. The Promoters and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
    15. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware, or software failures of any kind which may restrict, delay, or prevent a participant’s entry to the promotion.
    16. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
    17. Any question concerning the legal interpretation of the rules will be based on English law and the Courts of England and Wales will have exclusive jurisdiction unless you live in Scotland, in which case your local courts will have jurisdiction.
    18. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose unless we have your consent. Any data obtained as part of the entry process for the promotion will be stored for 3 months after the close of the promotion before deletion. Your personal details will always be kept confidential and in accordance with current Data Protection legislation.
